Relationship to Keller Williams
J.L. Miller Realty is an independent real estate team affiliated with Keller Williams. Keller Williams Realty, LLC’s own Terms of Use apply to Keller Williams’ corporate sites and platforms. This Agreement applies to your interaction with our Site and services.
Changes to Terms
We may modify these Terms at any time by posting a revised version to the Site or via notice. Continued use of the Site after such modification constitutes your acceptance of the updated Agreement.
Use of the Site & Acceptable Conduct
You agree that you will not:
– Use the Site for any unlawful or fraudulent purpose.
– Post or transmit content that is defamatory, obscene, harassing, hateful, infringing, or otherwise objectionable.
– Introduce viruses, malware, or harmful code; interfere with the operation of the Site; or try to bypass security measures.
– Use bots, spiders, scrapers, or other automated methods to access or collect Site content without our express permission.
– Impersonate another person or misrepresent your identity.
– Remove or alter any copyright, trademark, or proprietary notices on Site content.
– Reproduce, modify, distribute, or publicly display Site content except as expressly permitted for personal, noncommercial use.
– Frame, mirror, or embed the Site (or parts) into other services without prior written consent.
Intellectual Property
All content, logos, designs, text, graphics, and software on the Site are the intellectual property of J.L. Miller Realty, our licensors, or applicable third parties. Except as explicitly permitted, no right, title, or interest is transferred to you by your use of the Site.
User Content
If you submit content to the Site (e.g., comments, inquiries, reviews), you grant us a nonexclusive, royalty‑free, irrevocable right to use, reproduce, modify, publish, distribute, and display that content in connection with operating the Site and our services. You represent that you own or have the rights to submit such content and that it does not violate any third‑party rights.
Disclaimers & No Warranty
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
We do not guarantee the Site will be uninterrupted, error‑free, secure, or that any content is accurate or reliable.
You assume all risk in connection with using the Site. Nothing in these Terms limits warranties that cannot be excluded under applicable law.
Limitation of Liability
IN NO EVENT WILL J.L. MILLER REALTY OR ITS AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT,
INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE,
EVEN IF ADVISED OF THE POSSIBILITY thereof.
Our aggregate liability under this Agreement shall not exceed the greater of $50 or any amounts you paid us in the prior twelve (12) months, to the extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless J.L. Miller Realty, its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising from your violation of this Agreement or your use of the Site.
Termination
We may suspend or terminate your access at any time and for any reason, with or without notice. Upon termination, your rights under this Agreement immediately cease, and we may block or delete your content or account without liability.
Governing Law & Disputes
This Agreement is governed by the laws of the State of Alabama, without regard to conflict of law principles.
Any dispute arising out of or relating to this Agreement or your use of the Site shall be resolved in the state or federal courts located in Jefferson County, Alabama, unless otherwise required by law.
You and we each consent to personal jurisdiction and venue in those courts.
Miscellaneous
– Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
– Waiver: A failure to enforce any right under this Agreement does not waive that right.
